D-LUX Rentals finds it essential that you (the hirer) have insurance, with the appropriate proof of cover, this must be sent to us before any equipment is taken away from our premises. Insurance needs to cover the amount of equipment being taken away from our premises, dates should include the date of collection and drop-off and not only the shoot dates . Please enquire about the value of the equipment you are hiring, miscalculation or values provided by any other place (internet, other friends in the industry, etc) will not be official and the hire will be liable for any other extra cost. Terms and Conditions. 

1.Responsibility 

1.1 The Hirer shall give such proof of her/his identity, as the Owner (D-LUX Rentals) shall reasonably require. 

1.2 The person who signs the hire contract and pays for the hire assumes the full financial responsibility for the equipment, until it is returned. Any late return of equipment may be charged at our discretion. 

1.3 All damage to the equipment shall be reported in writing to the Owners (D-LUX Rentals) via email (info@dlux-rentals.com) within 24 hours. 

1.4 The insurance liability for any lost, stolen or damaged equipment is with the customer/hirer. We retain the right to charge for any losses (material or financial) or damage to equipment whilst on hire. Daily loss of earnings will be charged until such equipment is replaced or repaired. Loss of earnings is charged at the equipment daily rate. 

1.5 The client & guarantor shall take all reasonable precautions to avoid loss/damage to the equipment during the period of hire. 

1.6 The client and guarantor are responsible for the safe handling of equipment. Repair or replacement costs up to £50,000 (£75,000 for overseas) will be billed to the debtor or guarantor for damage or loss occurring while the equipment is in the client's possession. 

1.7 It is the client’s responsibility to test and examine the equipment to determine that all hired equipment is in good working order and condition and fit for the client’s purpose. All equipment must be so tested on Location or at D-LUX Rentals premises. 

1.8 The equipment shall be deemed to be in good condition at the beginning of the hire period unless any damage shall have been noted on the delivery note. 

1.9 The equipment shall be the responsibility of the Hirer at all times when in the hirer's possession, and in the event of loss of goods or any item thereof from whatsoever cause or reason, shall immediately pay to the owner (D-LUX Rentals) the full costs of replacement. 

2.Hire Period 

2.1 The hiring period of the equipment shall commence at the time specified in the Agreement Form (As stated in the Quotes & Invoices) and shall finish when the equipment is returned to the Owner's premises, except when the Owner has agreed to receive/collect the equipment. 

2.2 The equipment must be returned (or made available for collection) at the time and date specified in the Agreement Form, (As stated in the Quotes & Invoices) unless in the meantime the Owners have agreed to an extension (which needs to be provided in writing - (info@dlux-rentals.com) - with both parties agreeing with the dates and costs for the extension).  

2.3 Extension of hire must be notified to the Owner at least 24 hours before the end of the original hire period - this needs to be provided in writing - (info@dlux-rentals.com) - with both parties agreeing with the dates and costs for the extension). 

2.4 The Company reserves the right to at its discretion to charge 50% of the order value if The Customer fails to provide 3 days’ notice of cancellation.

2.5 Advertised prices are subject to change by the Owners without prior notice, however once a booking is confirmed these prices will not change during the course of this booking.

2.6 For dry hire items a day is considered to be a 24-hour period starting at 7am. 

2.7 Hire charges for equipment are calculated from the time the equipment leaves D-LUX Rentals premises until the end of the period of hire or when the equipment is returned to D-LUX Rentals premises, whichever is the later.

2.8 The Hirer is welcome to collect the gear from 4PM (four in the afternoon) on the previous day and returned by no later than 11AM (eleven in the morning). Failing to follow this D-LUX Rentals have the rights to charge/add an extra day on the hirer’s invoice which will need to be paid as soon as possible.

3.Pick up & Delivery 

3.1 Equipment must be picked up by the close of business the day before hire commences and must be returned no later than 11am the day following your hire period - unless agreed otherwise (this must be agreed via email info@dlux-rentals.com).

3.2 A call-out fee may be charged for after hours pick up or delivery, normal working hours are as follows: 

9h00m -17h00m.

3.3 Courier charges apply to equipment delivered or collected by the Owners (the value for delivery/collection may vary depending on the distance from/to D-LUX Rentals premises, please enquire the different options when contacting D-LUX Rentals). 

3.4 When the HIRER decides to collect/return hired equipment from our premises, the collection/return times are as it follows:

COLLECTION: After 4PM clients are welcome to collect equipment from our office without any further costs (meaning, the client won't be charged for the day) eg:  Client books equipment for a day (let's say the 20th). Assuming payment has been cleared and all paperwork approved, our clients can come in and collect their order from 4PM on the 19th without any extra charges. If a client decides to collect prior 4PM on the previous day (19th in this example), an extra day will be added/charged to their invoice. 

RETURN: A similar prerogative is applied for returns. Items need to be returned no later than 11AM of the following day (using the example above in Collection, this would mean the client needs to return the equipment by 11AM on the 21st). Should this not be followed, an extra day will be added/charged to their invoice. The return of the equipment needs to be in full according to what is on the invoice (and or agreed upon via email, messages or any other medium that shows there was communication between client and D-LUX Rentals). If the equipment on the equipment list/invoice is returned incomplete, D-LUX Rentals has the rights to charge the equivalent for that item for as long as the client keeps the equipment (meaning until the items is returned to our office). In case the client can't organise the return D-LUX Rentals can provide collection for extra charges which can be discussed but it will be no less than our standard Delivery fees (starting from £100 - please email us for details at info@dlux-rentals.com). 

4.Payment 

4.1 Payment of first five hire charges must be made by bank transfer, prior to the commencement of the hire period unless an account has been established with the Owners. 

4.2 Accounts must be paid within 30 days of the Owners invoice date (this applies to SERVICES only and a deposit of 50% might be required). DRY HIRE needs to be paid in full prior collection/delivery. If payment has not been cleared D-LUX Rentals staff will not release any equipment until payment is confirmed.  

4.3 Payment for hire shall be made within thirty days of invoice, unless the Hirer chooses to accept any discount offered, for alternative payment terms, in which case alimony due must be in our possession before the last day of the period, to which the discount refers. Late payment shall incur immediate loss of discount and a new agreement must be made, but this still means that the client is responsible fr the original cost as well as any new cost this may incur. All payments must be made in (£) sterling. 

4.4 The Owners reserves the right to refuse to hire equipment to the client, in the event that the client fails to comply with D-LUX Rentals terms of payment. 

4.5 If the Hirer shall make default, in punctual payment of the sums to be paid by it for the hire of the equipment, or shall fail to observe or perform the terms and conditions, of the agreement on its part to be observed, and performed or if the Hirer shall do, or cause to be done, or permit or suffer, any act or thing whereby the Owner's rights in the equipment may be prejudiced, or put in jeopardy, this agreement shall forthwith determine (without any notice or other act on the part of the Owner and notwithstanding that the same or like nature) and it shall thereupon be lawful for the Owner to retake possession of the equipment, and for that purpose enter into or upon any premises where the same may be, and the determination of the hiring under this clause shall not affect the right of the Owner, to recover from the Hirer any monies due to the Owner under this agreement or damages for breach thereof. 

5. Insurance 

5.1 The hirer shall keep the equipment insured against fire, loss, damage or risk from any cause arising in the full replacement value thereof, & will permit the Owner at all reasonable times to have access to the equipment and to inspect the state & conditions thereof. 

5.2 If the equipment shall be injured or destroyed by fire, all monies received or receivable in respect of such insurance as aforesaid shall forthwith be received by the Owner who shall, as the case may require, apply such monies either in making good the damage done or in replacing the equipment by other articles of similar description and quality and such substitute articles shall become subject to the provisions of this agreement in the same manner as the articles for which they shall have been substituted. 

5.3 The sum insured must not be less than the current value of 'same week' replacement of equipment. 

5.4 Where you are more than one person or entity this agreement is binding on each of you jointly and severally.

5.5 The hirer shall not remove equipment from the UK without obtaining the Owner's consent in writing specifying the country to which the equipment is to be removed and in such event the Hirer shall pay additional insurance in respect of such removal of the equipment and shall indemnify the Owner against all customs duties, taxes or other pecuniary levies either as a result of removal of, or return of the equipment from the UK and shall pay to the owner, if required, 10% of the value of the equipment supplied by way of a deposit, each sum to be returned to the Hirer at termination of hiring by Owner after deduction of any monies due by the Hirer to the Owner. 

5.6 Any waiver or other indulgence granted by the Owner shall not affect the strict rights of the Owner (D-LUX Rentals - Terms & Conditions January 1, 2020) under these terms. 

5.7 If equipment hired is covered under D-LUX Rentals' insurance policy an excess of £500 per box is stipulated, this excludes thefts from unattended motor vehicles wherein the excess increases to £2500 per box. All boxes will continue to incur full daily hire charge until replacement/repair is complete and equipment is returned to hire-able status. 

5.8 Responsibility for shipping, preparation of Carnet & Customs documents & lodging of any bonds shall be entirely that of the hirer.
