These Terms & Conditions apply to all equipment rentals and services provided by D-LUX Rentals.
Acceptance of a quotation, booking confirmation, or collection of equipment constitutes acceptance of these Terms & Conditions.

1. INTRODUCTION & ACCEPTANCE OF TERMS

These Terms & Conditions apply to all equipment rentals and services provided by D-LUX Rentals Ltd (“D-LUX Rentals”).

Acceptance of a quotation, booking confirmation, instruction to proceed, collection of equipment, or delivery of equipment constitutes acceptance of these Terms & Conditions by the hirer.

These Terms & Conditions apply to all hire agreements unless expressly agreed otherwise in writing by D-LUX Rentals.

Where the hirer acts on behalf of a production company, client, or third party, the hirer confirms that they have authority to bind that party to these Terms & Conditions.

2. DEFINITIONS & INTERPRETATION

In these Terms & Conditions, the following definitions apply:

“D-LUX Rentals” means D-LUX Rentals Ltd.

“Hirer” means the individual, company, production, or organisation hiring equipment or services from D-LUX Rentals, including any person acting on their behalf.

“Equipment” means all equipment, accessories, components, cases, packaging, and related items supplied by D-LUX Rentals, whether owned, hired, or sub-hired.

“Hire Period” means the period commencing when the Equipment leaves D-LUX Rentals’ premises (or is collected or delivered) and ending only when the Equipment is returned to D-LUX Rentals and checked back in.

“Quotation” means any written quotation, estimate, or confirmation issued by D-LUX Rentals, including any attached schedules or equipment lists.

“Total Replacement Charge” means the combined full replacement value of the Equipment listed on the Quotation.

“Services” means any services provided by D-LUX Rentals, including (but not limited to) crew, preparation, delivery, collection, testing, or technical support.

“Working Day” means Monday to Friday, excluding public holidays in England and Wales.

References to the singular include the plural and vice versa.
References to any statute or regulation include any amendment or re-enactment thereof.

3. HIRE PERIOD & RESPONSIBILITY

The hire period begins at the moment the equipment leaves D-LUX Rentals’ premises, whether by collection or delivery, and ends only once the equipment has been returned to D-LUX Rentals and checked back in.

The hirer accepts full responsibility for the equipment throughout the entire hire period, including during transport, loading and unloading, storage, use, and return.

The hirer is responsible for ensuring that the equipment is used only by competent and suitably qualified personnel and strictly in accordance with manufacturer instructions and industry-standard practices.

The hirer shall ensure that the equipment is kept secure, protected from adverse conditions, and not left unattended or exposed to risk where loss, theft, or damage could reasonably be anticipated.

The hirer shall not assign, sub-hire, lend, modify, or part with possession of the equipment without the prior written consent of D-LUX Rentals.

Any extension of the hire period must be agreed in writing by D-LUX Rentals in advance. Failure to return equipment at the agreed time may result in additional hire charges and does not limit the hirer’s responsibilities under these Terms & Conditions.

4.INSURANCE

The hirer is responsible for ensuring that all equipment is fully insured before collection, delivery, or use.

Insurance must:

  • Be in the hirer’s name

  • Cover the full replacement value of all equipment hired (values to be confirmed by D-LUX Rentals)

  • Include cover for loss, theft, and accidental damage

  • Be valid for professional film, television, or commercial use

Insurance must remain valid for the entire hire period, from the moment the equipment leaves D-LUX Rentals until it is returned and checked back in.

Total Replacement Charge

For transparency, all quotations issued by D-LUX Rentals include a Total Replacement Charge, representing the combined full replacement value of the equipment listed.

This figure is calculated based on replacement values assigned to individual items within our inventory system and is provided to assist the hirer in arranging adequate insurance cover.

The hirer acknowledges that the Total Replacement Charge stated on the quotation reflects the value that must be insured and forms the basis of the hirer’s liability in the event of loss, theft, or damage.

The responsibility to provide valid insurance remains with the hirer at all times. Where equipment is released, collected, or delivered prior to insurance documentation being received, reviewed, or confirmed by D-LUX Rentals, the hirer remains fully liable for the equipment and for any loss, theft, or damage at full replacement value, regardless of any administrative or timing considerations.

5. LOSS, DAMAGE & THEFT

The hirer accepts full responsibility for all equipment supplied by D-LUX Rentals for the duration of the hire period.

The hire period begins at the moment the equipment leaves D-LUX Rentals’ premises (or is collected or delivered) and ends only once the equipment has been returned and checked back in by D-LUX Rentals.

The hirer shall be liable for:

  • Any loss, theft, damage, or breakage of equipment

  • Any partial loss or damage, including components, accessories, cases, cables, or packaging

  • Any damage arising from misuse, negligence, improper handling, unauthorised modifications, or failure to follow manufacturer or industry-standard operating practices

Where equipment is lost, stolen, or damaged beyond economic repair, the hirer shall be liable for the full replacement value of the affected equipment.

Where equipment is damaged but repairable, the hirer shall be liable for:

  • All repair costs

  • Any associated testing, calibration, or inspection costs

  • Any loss of hire incurred while the equipment is unavailable for use

Loss of hire shall be calculated based on the period during which the equipment is unavailable for hire, using D-LUX Rentals’ standard hire rates.

The hirer acknowledges that the Total Replacement Charge stated on the quotation represents the combined full replacement value of the equipment supplied and forms the basis of the hirer’s liability.

D-LUX Rentals shall not be liable for any loss, damage, or theft of equipment once it has left our control, including where such loss or damage is caused by third parties.

The hirer’s liability to D-LUX Rentals is not affected by the terms, conditions, exclusions, excesses, or performance of any insurance policy.

Any refusal, limitation, delay, or failure by an insurer to pay all or part of a claim does not reduce or remove the hirer’s responsibility for loss, theft, damage, repair costs, or loss of hire.

Where loss, theft, or damage occurs, D-LUX Rentals reserves the right to invoice the hirer accordingly. Payment shall be due in accordance with the payment terms stated in these Terms & Conditions.

6. USE OF EQUIPMENT / CARE & RESPONSIBILITY

The hirer shall use the equipment with all due care and in a proper and workmanlike manner, in accordance with manufacturer instructions, industry-standard practices, and any guidance provided by D-LUX Rentals.

The equipment shall be used solely for its intended purpose and shall not be subjected to misuse, negligence, abnormal conditions, overloading, improper power supply, unauthorised modifications, or unsafe operation.

The hirer is responsible for ensuring that all persons operating or handling the equipment are competent, suitably qualified, and adequately supervised.

The hirer shall ensure that the equipment is kept clean, secure, and protected from adverse environmental conditions, including (but not limited to) moisture, extreme temperatures, dust, and impact.

No repairs, adjustments, or modifications may be carried out on the equipment without the prior written consent of D-LUX Rentals. Any unauthorised repairs or alterations may result in the hirer being liable for resulting damage, additional repair costs, or full replacement.

Any fault, malfunction, or damage to the equipment must be reported to D-LUX Rentals immediately. Continued use of damaged or faulty equipment is strictly prohibited and may increase the hirer’s liability.

7. DELIVERY & COLLECTION

Delivery and collection of equipment may be arranged by D-LUX Rentals or undertaken by the hirer, as agreed in advance.

Where delivery or collection is arranged by D-LUX Rentals, the hirer shall ensure that accurate details are provided in advance, including dates, times, addresses, access instructions, and a responsible on-site contact with a valid telephone number.

The hirer is responsible for ensuring that access to the delivery or collection location is available at the agreed time. Any delays caused by restricted access, unavailable contacts, or site conditions beyond D-LUX Rentals’ control may result in additional charges.

Waiting time may be charged where D-LUX Rentals’ staff or drivers are required to wait due to delays or access issues. Waiting time shall be charged in accordance with the rates outlined on the Delivery & Collection page.

Any statutory road user charges, tolls, congestion charges, parking costs, or access-related fees incurred in connection with delivery or collection shall be charged at cost and added to the hirer’s invoice.

Risk and responsibility for the equipment pass to the hirer in accordance with the hire period as defined in these Terms & Conditions, regardless of whether equipment is delivered, collected, or transported by third parties.

8. PAYMENTS & INVOICING

All charges are payable by the hirer in accordance with the terms set out in this section.

Equipment Rental

Payment for all equipment rentals must be received and cleared in full before any equipment is released from D-LUX Rentals’ premises or delivered to site, unless otherwise agreed in writing.

Services

Where services are provided (including crew), payment terms are 30 days from invoice date, unless otherwise agreed in writing.

Invoices & Payment Method

All invoices are issued by D-LUX Rentals and must be paid by bank transfer using the details provided on the invoice. The hirer shall ensure that the correct invoice reference is used when making payment.

VAT

All prices are exclusive of VAT unless expressly stated otherwise. VAT shall be charged at the applicable rate.

Late Payment

Late payments may incur interest and recovery costs in accordance with applicable legislation and may result in suspension of future hires or services at D-LUX Rentals’ discretion.

Payment of invoices shall not be withheld by the hirer on the basis of any dispute with an insurer or third party.

D-LUX Rentals reserves the right to suspend ongoing or future hires and services where invoices remain unpaid beyond agreed terms.

Interest may be charged at the statutory rate under the Late Payment of Commercial Debts (Interest) Act 1998, together with reasonable recovery costs.

9. CANCELLATIONS & VARIATIONS

The hirer acknowledges that availability of equipment and services is reserved once a booking is confirmed and that preparation and scheduling may commence prior to the hire period.

Cancellations

In the event of cancellation by the hirer, D-LUX Rentals reserves the right to charge:

  • Any costs already incurred, including preparation, testing, packing, loading, or administrative time

  • Any hire charges relating to equipment or services that were reserved and are no longer available to be hired to other clients

Cancellation charges may be applied up to the full value of the booking, depending on the timing of the cancellation and the extent of work already undertaken.

Variations & Date Changes

Requests to vary or move hire dates are subject to availability and must be agreed in writing by D-LUX Rentals.

Where a booking is moved to alternative dates and the originally reserved equipment and services remain available, D-LUX Rentals may, at its discretion, apply the charges to the revised dates in lieu of cancellation.

Where the equipment or services are no longer available for the revised dates, the original booking shall be treated as a cancellation and cancellation charges may apply.

Preparation & Reserved Availability

Preparation, packing, testing, and loading time forms part of the hire service and may be chargeable even where equipment is not ultimately collected or delivered.

10. LIMITATION OF LIABILITY

Nothing in these Terms & Conditions shall limit or exclude liability for death or personal injury caused by negligence, fraud, or any other liability which cannot be limited or excluded under applicable law.

Subject to the above, D-LUX Rentals shall not be liable for any indirect, consequential, or economic loss, including (but not limited to) loss of profit, loss of production time, loss of use, or loss of opportunity, arising from the hire or use of equipment or services.

D-LUX Rentals shall not be liable for any delay, failure, or interruption to a production caused by equipment malfunction, breakdown, or unavailability, except where such liability cannot be excluded by law.

Where liability cannot be excluded, D-LUX Rentals’ total liability to the hirer arising out of or in connection with any hire or service shall be limited to the total hire charges paid by the hirer for the relevant booking.

The hirer acknowledges that all equipment is supplied for professional use and that it is the hirer’s responsibility to ensure suitability for the intended application.

11. GOVERNING LAW & JURISDICTION

These Terms & Conditions and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms & Conditions.
